Terms of Service

These Terms of Service ("Terms") govern your use of Pumlo ("the App"). By using the App, you agree to these Terms on behalf of yourself and any child who plays the App on your device.
1. Eligibility
The App is designed for children ages 2 through 9 to use with adult supervision. By installing or using the App, you represent that you are an adult agreeing to these Terms on your own behalf and on behalf of any child you allow to use the App on this device.
2. Licence to Use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App for personal, non-commercial purposes on devices you own or control, consistent with the Apple Media Services Terms and Conditions.
3. Subscriptions
The App offers an optional monthly subscription that unlocks additional games. Subscriptions are sold and processed by Apple App Store, not by us. The subscription:
• Is billed monthly to your Apple ID at the price shown in the App at the time of purchase. • Renews automatically at the end of each billing period unless you cancel at least 24 hours before the renewal date via Settings → your Apple ID → Subscriptions. • Can include a free trial for first-time subscribers; cancelling during the trial avoids any charge.
4. Free Trial
New subscribers may be eligible for a 3-day free trial. If you start a free trial and do not cancel through Apple at least 24 hours before the trial ends, your subscription will begin and your Apple ID will be charged at the regular price. Eligibility for free trials is determined by Apple.
5. Cancellation and Refunds
You may cancel a subscription at any time via Settings → your Apple ID → Subscriptions. Cancellations take effect at the end of the current billing period; the App stays unlocked until then. Refund requests are handled by Apple, not by us — visit reportaproblem.apple.com to submit one.
6. Restoring Purchases
If you reinstall the App or switch devices, you can restore an active subscription via Parent Area → Restore Purchase. The device must be signed in with the same Apple ID used for the original purchase.
7. Acceptable Use
You agree not to: copy, modify, decompile, reverse-engineer, or attempt to extract source code from the App; remove copyright or attribution notices; or use the App for any unlawful purpose. The App contains no chat, social, or user-generated-content features.
8. Intellectual Property
All content in the App — including game logic, art, sound, text, and design — is owned by the App developer or licensed for use in the App. These Terms do not transfer any rights to that content beyond the personal-use licence in Section 2.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or compatible with every device or iOS version.
10. Limitation of Liability
To the maximum extent permitted by law, the App developer is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Total liability for any direct damages will not exceed the amount you paid for App subscriptions in the 12 months preceding the claim.
11. Termination
You may stop using the App at any time and delete all locally stored data via Parent Area → Delete Local Data. We may terminate or suspend access to the App if you violate these Terms, with or without notice.
12. Changes to These Terms
We may update these Terms occasionally. The "Effective" date above will reflect the most recent revision. Continued use of the App after a material change constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of California and the federal laws of the United States of America applicable therein, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the App will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.
14. Supported Regions
The App is distributed through Apple App Store storefronts worldwide, with the exception of mainland China. Region availability may change over time; the live list is the App Store storefront on your device. Use of the App from a region where it is not distributed is not authorised.
